The EXIZE company's online store operating under the address www.exize.eu is run by Maciej Krupniewski, with its registered office at 50-040 Wrocław, Podwale Street 37/38 office 42, NIP (Tax Identification Number) 748-151-75-93.

Its purpose is to enable making purchases via the Internet.

DEFINITIONS:

Offer – goods / products placed on the online store website www.exize.eu

Client – any natural person with full legal capacity, making purchases in the Store.

Cart – a functional element of the Store, which allows the Client to make purchases via www.exize.eu

Working days – all days of the week from Monday to Friday, except holidays.

Order processing time – the time in which the Store will complete the order and hand it for dispatch via a courier company.

PLACING ORDERS:

All products offered in the www.exize.eu Store are new, free from physical and legal defects and have been legally placed on the Polish market.

Reviewing the offer, the Client should choose a product with its attributes and add it to the cart by clicking "add to cart". After selecting the products the order processing phase starts. In order to do so, click on the "ORDER NOW" button in the cart and then choose one of 3 available options: place an order, create an account or sign in.

Creating an account gives the Client the opportunity to view the order history and frees from having to fill in the form with data on the next order. Client can change their data and account settings at any time.

The next step is to choose the payment method.

The realisation of the order placed by the Client should begin only after the Seller receives confirmation of the correct payment, unless the method of payment "cash on delivery" is chosen. The order will be automatically cancelled if the payment is not made within 5 calendar days, unless the method of payment "cash on delivery" is chosen. Ordered products are not reserved until the payment is credited.

All prices given in the Store are gross retail prices. The price of the goods given in the content of a given offer of the Store includes taxes and all fees required by law. Discount coupon codes reduce the price of products offered only in regular prices (without discounts).

Please report the need to issue an invoice to the shop staff.

DELIVERY:

Delivery costs are covered by the buyer.

In case of delivery to a destination outside the Member States of the European Union, the price to be paid for the purchased goods may be increased by the value of the relevant customs duties.

In case of an order outside the country, please contact us to determine the delivery costs.
For foreign orders it is possible to make a prepayment via bank transfer in PLN or EUR.
Delivery in Poland is carried out mainly by the courier company Fedex and by the company InPost - parcel lockers.

The Client can choose one of the following payment methods:

  • cash on delivery (payment to a Fedex courier at receipt of the parcel)
  • online payment via Blue Media S.A.
  • card payment:

If the Client chooses to pay via bank transfer, the Client is obliged to make the payment within 5 calendar days from the date of the Sale Contract conclusion.

WITHDRAWAL FROM THE CONTRACT:

You have the right to withdraw from this contract within 14 days without giving any reason. The period for withdrawal shall expire 14 days after the date on which you acquire possession of the goods or on which a third party other than the carrier and indicated by you acquires possession of the goods.

In order to exercise your right of withdrawal, you must inform us of your decision to withdraw from this contract by an unequivocal statement (for example, by sending an e-mail to info@exize.eu).

In order to meet the withdrawal deadline, it is sufficient for you to send us the information concerning the exercise of your right of withdrawal before the withdrawal period has expired.

A consumer does not have the right to withdraw from a contract if the purchased goods are non-prefabricated, made to the consumer's specifications or to satisfy their individual needs (Article 38(3) of the Act on consumer rights). This applies to products which have been made on the basis of an individual choice or decision of the consumer. These are clearly individualised goods, such as e.g. a different colour of a T-shirt, printing or an individual choice of type of clothing.


If you withdraw from this contract, we will reimburse all payments received from you, except for the delivery cost, immediately and in any event no later than 14 days from the date on which we are informed of your decision to exercise your right of withdrawal from this contract. We will reimburse you using the same payment methods as you used in the original transaction, unless expressly agreed otherwise. In any event, you will not incur any fees in relation with the reimbursement.

In the event of a need to return funds for a transaction made by the Client with a payment card, the seller will return them to the bank account assigned to the Client's payment card.

We may withhold the reimbursement until we have received the item or you have provided us with proof of its return, whichever is earlier.

Please return the item immediately to the address: Maciej Krupniewski EXIZE, Podwale 37/38 office 42, 50-040 Wrocław, and in any case no later than 14 days from the day on which you informed us of your withdrawal from this contract. The deadline is met if you send back the item before the deadline of 14 days.

You will have to bear the direct costs of returning the item. Please send us also the proof of purchase with the goods (invoice or receipt), which will improve the return procedure.
The online store does not accept "cash on delivery" returns.

 COMPLAINTS RELATED TO ORDERS:

 The Exize Store as a seller shall be liable to the Client who is a consumer within the meaning of Article 22[1] of the Civil Code, under the warranty for defects to the extent specified in the Civil Code, in particular Articles 556[1]-556[3] of the Civil Code.

Complaints resulting from infringement of the Client's rights guaranteed by law or on the basis of these Regulations should be addressed to info@exize.eu. The Exize Store undertakes to consider each complaint within 14 days, and if this proves impossible, to inform the Client within this period about the time when the complaint shall be considered.

COMPLAINTS RELATING TO THE PROVISION OF SERVICES BY ELECTRONIC MEANS:

The Exize Store shall take steps to ensure that the Store operates fully correctly, to the extent that it is based on current technical knowledge, and undertakes to remove any irregularities reported by Clients within a reasonable time.

The Client is obliged to immediately notify the Exize Store of any irregularities or interruptions in the functioning of the online store service.

The Client may report irregularities related to the functioning of the Store in writing to the address: Maciej Krupniewski EXIZE, Podwale 37/38 office 42, 50-040 Wrocław or by e-mail to info@exize.eu

In the complaint, the Client should provide their name, address, type of the irregularity related to the operation of the Store and the date it occured.

The Exize Store undertakes to consider each complaint within 14 days, and if this proves impossible, to inform the Client within this period about the time when the complaint shall be considered.

FINAL PROVISIONS:

Settlement of any disputes arising between the Exize Store and the Client, who is a consumer within the meaning of Article 22[1] of the Civil Code, shall be referred to the competent court in accordance with relevant provisions of the Civil Procedure Code.

In matters not regulated by these Regulations, the provisions of the Civil Code, the provisions of the Act on provision of services by electronic means and other relevant provisions of Polish law shall apply.

NEWSLETTER:

The Client may agree to receive the Newsletter provided by Exize. The Newsletter shall be sent only to Clients who have ordered the Newsletter by ticking the appropriate box in the registration form or order form and have agreed to receive commercial information, within the meaning of the Act of 18 July 2002 on provision of services by electronic means (consolidated text Journal of Laws 2013, item 1422), to the provided e-mail address.

Within the Newsletter service, information in the form of an e-mail shall be sent to the e-mail address provided by the Client. The Newsletter contains in particular information about the offer of Exize products such as new collections, current promotions and other information about products offered by Exize. The newsletter is sent free of charge.

The customer may at any time, without giving a reason and at no cost, change the indicated e-mail address to which the Newsletter is sent or resign from the Newsletter by clicking on the Newsletter link placed in the footer of each Newsletter, entering their e-mail address in the appropriate field and then selecting the "Unsubscribe" button.

PERSONAL DATA AND PRIVACY POLICY:

Personal data provided by the Client during the process of registration, placing an order or reservation of goods are processed by Maciej Krupniewski EXIZE with its registered office at 50-040 Wrocław, Podwale 37/38 office 42, having tax identification number (NIP): 748-151-75-93, REGON number: 383835050, which is the administrator of personal data.

This data is collected and stored in accordance with the Act of 29 August 1997 on personal data protection (Journal of Laws 2014, item 1182).

An essential element of the registration procedure, placing an order or booking of goods is the provision of the Client’s personal data, marked as obligatory, and the Client's consent to the processing of his personal data provided during registration. Providing personal data marked as obligatory is voluntary, however, it is necessary to register, place an order or make a reservation of goods, their implementation and service. Providing personal data not marked as obligatory is voluntary. If the Client has agreed to the service provided by electronic means, the subject of which is the free provision of newsletters, the obtained e-mail address is added to the e-mailing list and is used for marketing purposes to send the Client commercial information by e-mail in the form of a Newsletter.

Consent to the processing of personal data is given by ticking the appropriate box on the form.

The collected personal data shall not be made available to third parties, with the exception of providing the data to an entity participating in the processing of the order in order to deliver the ordered goods to the Client, i.e. courier companies. If the payment for the ordered goods is made in advance, the data is also transferred to the entity through which the transaction is settled. Personal data may be entrusted to an Internet service provider sharing server room resources to a personal data administrator (hosting service provider).

The Client has the right to obtain information whether and to what extent their personal data are processed, as well as information about the purpose and scope of processing his personal data. For this purpose, the Client should contact Maciej Krupniewski Exize via the Internet address info@exize.eu.

Exize, as the personal data administrator, may entrust another entity, by way of a written agreement, with the processing of personal data, in accordance with Article 31 of the Act of 27 August 1997 on personal data protection.

Exize uses cookie files, i.e. small text and number files, which are saved by the communication and information system in the User's communication and information system (on the computer, phone or other User's device from which the connection with the Service has been made) during browsing the Service, including the "Shop online" subpage and allow for later identification of the User in case of a renewed connection with the Service from the device (e.g. computer, phone) on which they were saved.

Cookie files collect data concerning the use of the Service, including the "Shop online" subpage, by the User, and their main purpose is to make it easier for the User to use the Service, adjusting the Service pages to the needs and expectations of a given User (personalisation of the Service subpages), researching User traffic within the Service.

Cookie files are used in the Service with the User's consent. The consent may be expressed by the User through appropriate software settings, in particular the Internet browser, installed in a telecommunications device used by the User to browse the content of the Service.

Service User can also at any time limit or disable cookies in their browser by setting it to block cookies or warn User about saving cookies on the device used for browsing the Service content. In this case, however, it may happen that the use of the Service, including the subpage "Shop online" will be less efficient, the User will not have access to some of the content, and in extreme cases, the correct display of Service pages, including the subpage "Shop online" may be completely blocked.
